Department of Finance Canada, Legal Services Unit:
The Department of Finance Canada is responsible for the overall stewardship of the Canadian economy. DLSU counsel provide legal and policy advice to it along with two agencies that report to the Minister of Finance: Financial Consumer Agency of Canada (FCAC) and the Financial Transactions and Reports Analysis Centre of Canada (FINTRAC). Some of the legal services provided concern budgetary and fiscal issues, the regulation of financial institutions, Federal-Provincial fiscal relations, international trade law, money laundering and terrorist financing.

Intent of the process

The immediate need is to staff up to four (4) positions with the Tax Law Services Portfolio / Canada Revenu Agency, Legal Services and one (1) position with the Central Agencies Portfolio / Finance, Legal Services, on an indeterminate basis.

The Canada Revenue Agency Legal Services Unit is seeking applications from counsel who will complement their dynamic team of highly dedicated lawyers. Candidates may be selected based on professional experience acquired in certain sectors.

A pool of partially or fully qualified candidates may be established from this process which may be used to staff similar positions within the Department of Justice with various tenures (indeterminate, acting/acting extension, specified period, assignment/secondment, deployment, etc.), various language requirements (English essential, English or French Essential, Bilingual Imperative of various levels BBB/BBB, CCC/CCC, CBC/CBC) and various conditions of employment, which may vary according to the position to be staffed.

OCCUPATIONAL CERTIFICATION:
OC - Eligibility for membership as a lawyer in the Bar of one of the provinces or territories of Canada or as a notary in the Chambre des notaires du Québec.

EXPERIENCE:
EX1 - Recent and significant experience providing legal services* in the area of federal tax law.

* Recent and significant experience providing legal services is defined as the depth and breadth of experience normally associated with :
- the performance of the duties working on legal and/or legal policy matters as counsel over a period of approximately four (4) years within the last six (6) years, OR
- a combination of experience in a tax law related function for at least six (6) years within the last eight (8) years and whose services are defined as follows:

• conducting legal research and analysis;
• litigation support; or
• providing strategic advice with respect to policies.

ASSET QUALIFICATIONS:
AED - Completion of LLM (or equivalent) with a specialization in an area of law relevant to the position(s) to be staffed.

AEX1 - Experience related to one or more of the following:
• Income Tax Act
• Excise Tax Act
• Greenhouse Gas Pollution Pricing Act
• Collections, bankruptcy or insolvency in a tax context
• Obtaining information for tax purposes in a tax audit or tax collection context
• International tax including tax treaties or transfer pricing
• Policy and regulations related to the administration of taxes in Canada

Only for the position with Finance/Legal Services:
AEX2 - Experience in drafting legislation or regulations.

Conditions of employment

Secret security clearance - Remain a member in good standing of the Law Society of a province or territory of Canada with the Law Societies or in the Chambre des notaires du Québec.
Willing and able to work extended hours including weekends.
Willing and able to travel, as required.

On October 6, 2021, the Government of Canada announced details of its plans to require vaccination across the federal public service.
