OCCUPATIONAL CERTIFICATION:
• Eligibility for membership in the Law Society of New Brunswick.
ESSENTIAL EXPERIENCE:
• Significant* experience leading or in taking on a leadership role in a criminal litigation team**, in the conduct of ill-defined and complex*** litigation.
• Experience in coaching and mentoring others on matters relating to criminal investigations and litigation.
*Significant is defined as experience associated with a broad range of progressively increasing complexity of criminal litigation over a six (6) year period accumulated within the past twelve (12) years.
**“Criminal litigation team”, could include a team of lawyers and support staff who together, form a team or an office with the responsibility of carrying on the criminal litigation work in a defined jurisdiction, or it could include a group of two or more counsel assigned to one prosecution file, with a lead counsel clearly identified, and could also include support staff who provide significant litigation support during all or most of the life of the prosecution file.
***“Ill-defined” and “complex”, is defined as the application of complex, intricate, uncertain, or emerging legal principles in the conduct of litigation involve complex legal and or factual matrixes (i.e. lengthy investigations with significant evidence gathered, often taking many forms, such as surveillance, intercepted communications, police agents, undercover police officers, Judicial authorizations, etc.… and often including more than one accused).
ASSET EXPERIENCE:
• Experience delivering training (e.g. in-house and/or to partner agencies)
• Experience supervising legal professionals, such as setting objectives, assigning files, and managing workload.
• Experience in leading a prosecution team consisting of a combination of counsel and legal support staff, in overseeing areas of criminal prosecution practice with federal subject matter responsibility relating to organized crime, controlled drugs and substances enforcement, fiscal or regulatory offences.
• Experience in handling complex criminal prosecutions which have included one or more of the following: wiretap authorizations, organized crime or conspiracy charges; high volume and complex disclosure management tasks; organizing, managing and presenting wiretap evidence.
• Experience in providing advice or conducting prosecutions under the Controlled Drugs and Substances Act.
• Experience in providing advice or conducting prosecutions under the Criminal Code.
• Experience advising on investigations or conducting litigation involving proceeds of crime charges or related applications.
ORGANIZATIONAL NEEDS:

OPERATIONAL REQUIREMENTS:
• Possession of a valid driver’s licence. Note: the license class must, at a minimum, authorize the driver to drive a car, van or small truck, on all roads and highways without an accompanying driver.
• Requirement to travel which may include assignments on short notice and for extended periods.
• Ability and willingness to work outside normal working hours which may include working evenings, nights and weekends based on operational needs.

KNOWLEDGE:
• In-depth* knowledge of the role and practices of Crown Counsel in the conduct of criminal litigation in the Public Prosecution Service of Canada.
• In-depth* knowledge of criminal law and procedure including knowledge of the Canadian Charter of Rights and Freedoms and its relevant case law.
• Knowledge of the Treasury Board’s Policy on the Prevention and Resolution of Harassment in the Workplace.
*In-depth is defined as specialist in one or more areas of law, having thorough knowledge.

CONDITIONS OF EMPLOYMENT:
• Being a member in good standing in the Bar of one of the provinces or territories of Canada.
• Must be a member, in good standing, of the Law Society of New Brunswick within 100 days of appointment.
• Applicants must be willing to be assigned to other types of work at the same group, level and tenure within the Public Prosecution Service of Canada. Assignment of work may be made within or between the various teams of counsel within the office and will be based on operational considerations and will not require relocation of residence.
• All employees of the core public administration are required to be fully vaccinated against COVID-19 and attest to their vaccination status unless accommodated based on a medical contraindication, religion, or another prohibited ground for discrimination as defined under the Canadian Human Rights Act.

On October 6, 2021, the Government of Canada announced details of its plans to require vaccination across the federal public service.
As per the new Policy on COVID-19 Vaccination for the Core Public Administration Including the Royal Canadian Mounted Police, federal public servants in the Core Public Administration and members of the RCMP must attest to their vaccination status. The requirement for employees to be fully vaccinated applies whether they are teleworking, working remotely or working on-site. This is a condition of employment and it applies to indeterminate (permanent), determinate (term), casual, and student hiring.
