Duties

The Hearing Officer reports directly to the Chairperson of the Trademark Opposition Board (TMOB). The main responsibilities for this position include presiding at Section 45 hearings, rendering final decisions on trademark matters pursuant to the Trademarks Act, rendering oral rulings at hearings, on interlocutory requests or procedural matters, prepares for hearings by reviewing evidence, written arguments, jurisprudence and by conducting legal research and rendering final decisions by preparing written decisions with reasons.

CIPO is a special operating agency of ISED. We are located at promenade du Portage, Gatineau, Quebec (walking distance to downtown Ottawa). The building is located in downtown Gatineau, with restaurants and boutiques close by. There is also easy access to public transportation and various paid parking options available. Like to exercise? A pool of fully or partially qualified candidates may be created and may be used to staff similar positions at the PM-04 group and level with various tenures and various linguistic profiles within Innovation, Science and Economic Development Canada.

Education
- A degree from a recognized post-secondary educational institution in a relevant field OR registration as a trademark agent

Degree equivalency

Experience
- Two years of experience in applying legislation, regulations and jurisprudence in writing documents

- Two years of experience in one of the following:
a) in preparing written submissions to tribunals or quasi-judicial tribunals
b) in writing or drafting court or quasi-judicial tribunal decisions (e.g. court clerk, stagiaire, member)
c) in trademarks prosecution or examination

The following will be applied / assessed at a later date (essential for the job)

- Five (5) years of experience in the field of trademarks
- Experience in appearing before or conducting hearings at quasi-judicial tribunals
- Two (2) years of experience in two (2) of the following:
a) in preparing written submissions to quasi-judicial tribunals
b) in writing or drafting court or quasi-judicial tribunal decisions (e.g. court clerk, stagiaire, member)
c) in trademarks prosecution or examination
