Duties

Articling with the legal services team of the Secretariat of the Canada Industrial Relations Board.

Under the guidance of the articling principal, the articling student will assist the legal services team with its mandate. This includes conducting legal research and providing sound legal advice and analysis on matters before the Board as well as drafting a variety of documents such as legal memoranda, case summaries and general correspondence. The student will also be called upon to assist the legal services team in reviewing Board decisions. When possible, the student will be encouraged to attend hearings and other proceedings before the Board.

Work environment

The Board is an independent, representational, quasi-judicial tribunal responsible for the interpretation and administration of Part I (Industrial Relations) of the Canada Labour Code, certain provisions of Part II (Occupational Health and Safety) of the Canada Labour Code and Part II (Professional Relations) of the Status of the Artist Act.

The legal services team is small, dynamic and collegial. Its primary mandate is to assist Board members in their decision-making role. It also assists Board officers in the development of strategies and solutions adapted to the Board’s operational needs. As such, the team is called upon to examine a variety of questions related to labour relations, administrative law and constitutional law.

Intent of the process

This is an Articling Student position for 2019-2020 with an intended start date of May or June 2019.

A fully or partially assessed pool may be created and may be used to staff similar positions at an identical or equivalent group and level with various linguistic requirements, tenures and security clearances within the Administrative Tribunals Support Service of Canada (ATSSC).

EDUCATION

At the time of appointment, candidates must be eligible for articles pursuant to the rules of the relevant law society (i.e. the province in which you are applying) and must have a law degree from a Canadian university.

Alternatively, the candidate may have a law degree from a university outside of Canada but must also obtain a Certification of Qualification issued by the National Committee on Accreditation or an attestation delivered by the Barreau du Québec’s Equivalences Committee.

The offer of employment will be conditional upon providing proof of receipt of a Bachelor of Law Degree (LL.B or LL.L) or Juris Doctor (J.D.) or Certification of Qualification issued by the National Committee on Accreditation or an attestation delivered by the Barreau du Québec’s Equivalences Committee prior to the appointment date.

Conditions of employment

Security clearance: Reliability Status – this factor is not used at the screening stage.

The Administrative Tribunals Support Service of Canada is responsible for the security clearance process.

The candidate must be eligible to article in accordance with their respective law society or with the École du Barreau du Québec at the latest on June 28, 2019, and during the articling appointment.

Candidates must obtain the above mentioned security clearance and maintain it throughout their employment.
