Work environment

The primary responsibility of the RCMP Recourse Appeals and Review Branch is the adjudication of grievances presented at the final level and certain other appeals established under the RCMP Act, the Regulations and the Commissioner’s Standing Orders. Recourse Analysts review grievance records, analyse the submissions of the parties, perform policy and legal research, and prepare background documentation to support the Adjudicator’s decision.

Intent of the process

The immediate need is to staff four positions on an indeterminate basis, with a linguistic profile of English Essential and Bilingual Imperative CPC/CPC and an RCMP Secret security clearance

A pool of candidates may be established and may be used to staff similar positions within the RCMP in the National Capital Region on an indeterminate or specified period (including term, acting, or assignment) basis, with various linguistic profiles and various RCMP security clearances.

Should a Civilian Member (CM) be found qualified and selected for appointment, the appointment will not result in a change of status to the Public Service (PS) category for the CM. Notification regarding the CM appointment will be sent to all applicable candidates who are within the area of selection and participated in the advertised process.

Should a Public Service (PS) employee be found qualified and selected for appointment, notification regarding the PS appointment will be posted accordingly on www.jobs.gc.ca.

In order to be considered, your application must clearly explain how you meet the following (essential qualifications)

Graduation with a degree from a recognized post-secondary institution with acceptable specialization in human resources management, labour or industrial relations, psychology, public or business administration, organizational development, education sciences, social sciences, or in any other field relevant to the work to be performed, such as a law degree recognized by a Law Society in Canada.

OR

An acceptable combination of education, training and/or experience, that is comparable to a degree from a recognized post-secondary institution with specialization relevant to the work to be performed.


NOTE: Examples of a possible acceptable combination of education, training and/or experience:
A certificate from a recognized post-secondary institution with specialization in law or legal studies and having performed work in a field and/or work environment specializing in the interpretation and application of statutory instruments* for the last five years.
OR
The applicant is enrolled in a law or legal program in a recognized post-secondary institution, has successfully completed at least 80% of the program, and has worked in a field and/or environment related to the interpretation and application of statutory and regulatory instruments for the last five years.

*Statutory instruments as defined in the Statutory Instruments Act R.C.S., 1985, c. S-22.

Degree equivalency

EXPERIENCE:
- Recent* and significant** experience in analyzing voluminous documents that contain legal material such as legislation, regulation, jurisprudence, as well as policies and arguments on issues of a legal nature.
- Recent* and significant** experience in analyzing complex issues.
- Recent* and significant** experience in conducting research in fields that relate to the responsibilities of the position, such as law for example.
- Recent* and significant** experience in drafting documents that include the analysis of legal issues.

*Recent is defined as within the last five (5) years.
**Significant is defined as the depth and breadth of experience associated with having performed a broad range of related activities which could be normally acquired over a period of approximately two (2) years.

- Experience in working in a quasi-judicial environment.
- Experience with one or more of the following: RCMP discipline process, a legislated grievance process, Canadian Human Rights Act, Privacy Act, Treasury Board Secretariat Policy on Prevention and Resolution of Harassment in the Workplace, duty to accommodate, administrative law, principles of natural justice and procedural fairness, judicial review.

- Willingness to work overtime, weekends and variable hours as required to meet operational requirements.
- Willingness to travel as and when required.
