Work environment

The Administrative Tribunals Support Service of Canada (ATSSC) is responsible for providing support services and facilities to 11 federal administrative tribunals by way of a single, integrated organization. These services include the specialized services required by each tribunal (eg, registry services, legal services, research and analysis services, and any other activity related to the mandate or specific files of a tribunal) which are provided by secretariats led by Executive Directors or Executive Directors and General Counsel.

The Federal Public Sector Labour Relations and Employment Board (FPSLREB) is one of the tribunals served by the ATSSC. The FPSLREB is an independent, quasi-judicial tribunal established by the Federal Public Sector Labour Relations and Employment Board Act. It is responsible for administering the collective bargaining and grievance adjudication systems in the federal public service and in Parliament. The FPSLREB is also responsible for the resolution of staffing complaints related to internal appointments and layoffs in the federal public service.

The position to be filled under the current process is that of Executive Director and General Counsel of the FPSLREB Secretariat, which includes over 65 employees. The Executive Director and General Counsel is responsible for leading the development, management and delivery of a range of specialized services enabling the Board to fulfill its mandate. He/she also serves as Head of Legal Services and Chief Legal Officer to the Chairperson and to the Board. He/she is therefore called upon to provide opinions and strategic advice and offer significant support on various complex legal issues, files and initiatives that have major impacts on the activities of the FPSLREB, and to represent the Board before the courts and at various forums. He/she is also responsible for leading the Secretariat’s legal team and ensuring the quality of the legal services it provides to the FPSLREB.

Intent of the process

The intent of the process is to staff the position of Executive Director and General Counsel, within the Federal Public Sector Labour Relations and Employment Board (FPSLREB) Secretariat of the Administrative Tribunals Support Service of Canada.

A pool of qualified candidates may be established for this position (Executive Director and General Counsel, FPSLREB Secretariat).

EDUCATION

ED 1 - Bachelor of Law from a recognized university;

ED 2 - Member in good standing of the Bar of one of the provinces or territories of Canada or of the Chambre des notaires du Québec.

EXP 1 - Significant* experience dealing with complex** issues of labour or employment law in a litigation or advisory capacity.

* Significant is defined as having the depth and breadth of experience normally associated with having performed a broad range of various related activities which would have been acquired over at least 5 years.

** Complex issues are defined as being highly technical, novel, multidimensional, precedent-setting or that could have a major impact on the organization or stakeholders.

*** Senior officials are individuals in higher ranks of an organization and could include Tribunal Chairpersons or Vice-Chairpersons, Deputy Ministers, Assistant Deputy Ministers, Presidents, Vice-presidents, Chief Negotiators, Senior General Counsels or similar equivalent.

**** Managing human resources is defined as directing or overseeing people/staff, including employee performance management, workload management, leading and directing teams through the setting of priorities and work activities. Applicants must indicate the number of staff reporting to them, as well as the length of time during which they managed these individuals.

***** Managing financial resources is defined as being accountable for a budget, which would include the responsibility for financial planning, forecasting and reporting. Applicants must indicate the size of the budget they managed, as well as the length of time during which they managed these resources.
